In the broadest sense, a fraud is an intentional deception made for personal gain or to damage another individual. What else would you call it? GS intentionally deceived people for their own gain. You can't go sell something while touting its the greatest money maker in the world the whole while knowing it is "Shit" and going against your own rhetoric and betting against it because you know you will make money. FRAUD!!!

Yes I found it hilarious and very telling that they have a financial reform bill all ready to go! The market does know, unfortunately the market is mostly made up of the big players. Unlike others here I'm not going to pretend to be a lawyer, but I did stay at a Holiday Inn last night.
Generally, fraud as I understand it involves a clear material misrepresentation. I'm sure there are many in depth examples and qualifiers for what constitutes fraud and I'm sure in many cases this is a matter for the court to decide.
If I label a can as containing 1lb of coffee and it only contains 1/2lb it is fraud. However, if I label it the world's best coffee and it is crap, it is buyer beware. When selling loans to a company that is in the business of assuming risk, it is difficult to establish fraud because the purchaser knows they are buying risk. The seller is not obligated to disclose their opinion and I see no reason they couldn't bet against the risk they sold.
Now the SEC does have some obscure laws that I am not familiar with but on its face, there is no fraud. If I have a stock, and i believe it is going to tank, I can certainly sell it and even sell short on it. The only way I have done something wrong is if I was involved in insider trading. Bottom line, the investors who bought the stock know exactly what they were buying.

Honesty and wall street, direct opposites. One must be duly aware of crookedness to qualify for a position on the street. It is business as usual and anyone doubting that is complicit. I will agree that there are a lot of smart guys on the street, but that does not equate to principles. In fact the smarter one is, the more they can get away with. Common sense is obviously missing in that venue, Just the old "lets see If I can fuck someone better than the next guy". The whole scam is trying to bilk people out of their hard earned cash, works pretty well, eh. They took down a lot of "widows and orphans" loot with the last great robbery. No reason to think it will change with some nuisance of a regulatory bill. Did not the main players walk away with a boatload of cash? Enough said. And just to be assholes, they paid themselves huge bonuses for fucking the people. I say hang em high. In Nv. we have a real scarcity of trees tall enough, we'd have to tie them to the back of our pick up trucks and drag them to death, my pleasure of course.
