The three plant rule in Colorado is what the amendment says but............ You can grow more, in the event of trouble you can easily argue the fact that three plants is not enough and you were growing what is medicinally necessary for you. Furthermore if you can convince the doctor to write in the amount of plants you would need and the amount you should keep on hand readily available for medication. It is completely legal, as per my attorney.
The law states that you need to recieve a recommendation from your doctor. This is exactly how most doctors are confused by the law. The powers that be who wrote this language knew exactly what they were doing. Rather than calling it a prescription, they call it a recommendation. This gives the governing agency the ability to deny MMJ to some people, or for them to revoke your right under law to use MMJ legally.
Wherefore if they were to call it a prescription, the law could not get involved because of doctor-patient confidentiality laws. A licensed qualified doctor is the only one who can lawfully write prescriptions for any medicine that is recognized under state law. Due to the fact that Cannabis is still a schedule 1 controlled substance according to federal law this prohibits doctors from writing prescriptions, due to the license they had to obtain from the DEA to prescribe drugs. This is what stops most doctors from recommending MMJ.
I was at my doctor's office last week for back pain that I've had since falling off of a 20' concrete wall when I was 14. I am now 34 and the pain is still around. I never went to the doctor for it when it occured. I told my doctor that I was not interested in pain killers because they make me sick and drowsy. I explained that I could not afford to go to see a physical therapist once a week or however often they would require. He told me I could go see a osteo therapist and they would inject me with meds and do extensive tests using experimental therapies and drugs. I told him that i would not be able to afford seeing the doctor all the time, and furthermore I told him I was not a guinea pig for some doctor to be doing experiments on.

He then offered me a set of flash cards with excercises on them to help me stretch my back and that would help me. I asked him what am I supposed to do when I can't even move enough to do anything much less get up and excercise. I asked if looking at those flash cards would make me feel better on those days. I explained that Tylenol doesn't work and aspirin and ibuprofen make me sick to my stomach. He basically told me that there was nothing more that he could do. I then asked him about signing a recommendation for MMJ. He said "What?" I then explained to him that MMJ was legal to patients who could benefit from the use of it. He then said " I don't have the authority do do that. I believe the state has special doctors for that."
I replied " If you are not qualified than how is it you are able to sit here and talk to me about my medical problems? And how can you offer me Flexoril, or any of the other drugs you were trying to sell me a minute ago legally? You are a Doctor right, an M.D.?" "Yes I am" he said. I told him "Then you are qualified." I told him that there are doctors who write recommendations all day long, I told him "All you have to do is make an appointment. Walk in tell the doctor you have a headache and the doctor hands you a piece of paper and says, that will be $500." I explained that it was not necessary because any M.D. or D.O. can legally sign the recommendation for MMJ.
"I don't do that" he said. I asked him if he was refusing service to me. He tried to explain all the options he gave me. I told him that I already explained that those options just won't work for me. He said that I just wanted to get a prescription for Marijuana. And that I was just being difficult with all my reasons why whet he offers won't work. I explained to the doctor that he may be the person who went to school to be a doctor and he is most likely smarter than me, but this body is mine and I will be the one to determine what goes in my body and his degree does not give him the right to be prejudiced against my prerogatives. "I don't do that" he repeats like a 5 year old. I told him that I was going to dispute payment to him from my insurance company for refusing service to me. I then walked out. So good luck getting a card, unless you are loaded.
