Jim Crowe laws haven't been nullified for 50 years yet. Slavery was abolished in the 1800's here, but the "separate but equal" crap persisted into the 60's. That means we aren't even fully removed from the generation that supported such laws. Racial discrimination is alive and well in the US. You can't just wish that shit away. It's not "going on" about what happened; it's dealing with an issue that still exists.

It's like there was no detriment to society from it being legal to hang a black man for walking on a white man's shadow. Goodness knows that the moment it was illegal; people abandoned that belief. People forget that one of the major arguments for making weed illegal was because it made minorities lust after white women, and vice versa. How quickly we forget how racist the people of this country have been until fairly recently.
Edit: The country is not racist as a whole, obviously. However, to say that it isn't a common issue up to this day is ridiculous.
