They need to check the flow rate of the oil, without knowing the flow rate BP will not get fined enough $. You just know that the "Estimate" will be on the low side if its not actually measured and BP will get off lightly since the fine is Per barrel of oil spilled. The difference could be billions.

They found that drilling the original well and releasing all that pressure caused the cracks and now they are seeping. They might be able to cement those shut, but since there is a media blackout and no fly zones we might never know whats really happening.

I wouldn't call what happened an accident, but rather a blatant disregard to industry safety and operating standards in order to save money on an over-budget and behind schedule well.
No one is winning from this spill, except maybe the company that makes the dispursants that they were using so liberally at the well-head and on the surface.
