How do search warrants work?

FBI agents can't just show up to search a property such as Mar-a-Lago or any other . Investigators first need to obtain a search warrant, which requires convincing a judge that they have probable cause that a crime occurred.

Federal authorities seeking a search warrant present their evidence and the basis for needing to search a property in an affidavit reviewed by a federal magistrate or district court judge.

Magistrate judges are not nominated by the president and are confirmed by the Senate. Instead, they are appointed by district court judges to handle matters such as search warrant applications and defendants' initial court appearances.

The judge can ask for additional information and question the agent seeking the search warrant under oath. The judge will only sign off on the warrant if there is probable cause there's evidence of a federal crime at the location authorities want to search. Given the sensitivity of an investigation involving a former president, there must have been a serious amount of deliberation by both the Justice Department and the judge.

The search warrant application process happens in secret in order to avoid tipping off the person whose property may be searched. Any court records related to the warrant application would be also sealed.

Those records typically remain under seal unless and until a criminal case is brought, and even then, authorities may try to keep the affidavit from public view. The person whose property is being searched is entitled to see the warrant, but not the affidavit.

If a property is searched without a valid warrant or probable cause, any evidence seized may be suppressed, which means it can't be used in court.

Secret service department officials onsite would also be notified and go through a verification with DOJ before allowing access.

I’m outraged — though not surprised — that the FBI under the direction of Merrick Garland’s DOJ, would seize the phone of a sitting Member of Congress.”

In his statement, first reported by Fox News, Perry added that his “phone contains info about my legislative and political activities, and personal/private discussions with my wife, family, constituents, and friends. None of this is the government’s business.”

A Justice Department spokesperson did not immediately respond to a request for comment.

Perry then compared the cellphone seizure to the FBI's search of Trump's Mar-a-Lago home in Palm Beach, Florida, on Monday.

“(A)s with President Trump last night, DOJ chose this unnecessary and aggressive action instead of simply contacting my attorneys. These kinds of banana republic tactics should concern every Citizen," Perry said.

Does anybody else miss the days when we had 3 news networks (ABC, NBC, CBS) who broadcast the same news every evening without adding a narrative and without chasing ratings and advertisers?

When it was a public service to give the viewing public the events and news of the day?

When civility was included in politics?

Go on YouTube and watch 10 minutes of the Nixon Kennedy debates. They were falling all over each other complimenting each other between answers.
Because that was what was expected from presidential candidates in that era.

One needs to analyze just why it's no longer like that to understand WTF goes on these days.

The rise of right wing media since the 1980s, the internet age, bullshit conspiracy theories, the total and complete loss of objectivity since Watergate...

Personally, I find it embarrassing to the country.
I often wonder how many people even recognize this. Apparently not many if you read Twitter.

Politics should be a tiny fraction of one's attention and then only around election day. Not 100% of the time every single day.

Former President Trump said he’ll be questioned on Wednesday in the New York attorney general’s investigation into his finances, confirming the deposition in a Truth Social media post.

“In New York City tonight. Seeing racist N.Y.S. Attorney General tomorrow, for a continuation of the greatest Witch Hunt in U.S. history!” Trump wrote. “My great company, and myself, are being attacked from all sides. Banana Republic!”

New York Attorney General Letitia James (D) and her office launched the probe into Trump and his company, the Trump Organization, over allegations that it misstated the value of assets and misled lenders and tax authorities.

James alleges in court filings that investigators found that the company “used fraudulent or misleading asset valuations to obtain a host of economic benefits, including loans, insurance coverage, and tax deductions.” It is also alleged that the size of Trump’s Manhattan-based penthouse was exaggerated.

Trump was initially scheduled to be deposed last month, but the questioning was delayed due to the death of his first wife, Ivana Trump

The attorney general’s office said that former President Trump’s deposition is one of the few remaining pieces it needs before concluding its investigation into the company.

Trump has repeatedly denied the allegations against his company, referring to James’s investigation as a politically motivated “witch hunt.”

Trump’s pending deposition comes two days after the FBI executed a search warrant at his Mar-a-Lago estate, with the search reportedly being focused on the classified documents that were brought to his Florida residence after the end of his presidential term.

The FBI search at Mar-a-Lago also came weeks after the Department of Justice launched its investigation into Trump’s role in the Jan. 6, 2021 attack on the Capitol and his efforts to overturn the 2020 election results.

Good to rattle him a day before he has to go in for his deposition.

How so?

When Turner started CNN, it was a straight up news channel as opposed to today's political round table discussion format as I remember.

And Fox in the 1990s wasn't spewing non stop lies during prime time with people like Hannity. They jumped on Clinton's blow jobs but so did everybody else.

When the FBI search warrant Mar-a-Lago story broke the other night, I watched 5 or 10 minutes of CNN, 5 minutes of MSNBC and 5 minutes of Fox. Then the baseball game came on and I rapidly escaped to better TV.

LOL, Rachel Maddow on MSNBC was slicing up Trump with a scalpel mentioning every current investigation into Trump.

CNN was making numerous speculations, but nobody actually really knows what was actually written on that search warrant or why the FBI was there.

Fox and Hannity just kept saying Hillary, Hillary, Hillary.

I thank all the networks for their continued objectivity.
OK, an FBI search of Trump is big news but nobody knows what was listed on the search warrant.
Rachel's going over all the current investigations we already knew. And where are the charges/indictments already?
And Fox's Hillary, Hillary, Hillary is an apples to oranges comparison and wishful thinking. And Fox lies nonstop in prime time and uses the 'we're actually entertainment' in court cases against them.

God I miss Walter Cronkite.

When I started watching TV again, the news was different. The human interest story was given more air than missile talks. For me, that was the carmel’s nose under the tent flap.
I still remember a 4th grade homework assignment where everybody had to watch the news and give a report on what they saw the next day.

Everybody had the same basic report. Lol.

I think our teacher just wanted to get us interested in watching the news early in life.

If a teacher told a bunch of 4th graders to watch the news today, I can't imagine what their parents would put on for them. Probably, whatever news the parents believe in which may have little to do with actual news and a lot to do with opinion.

And I'm not so sure 4th graders should be exposed to bullshit. Maybe that's part of the explanation of where we are today???
