That kind of activity will likely get this event shut down. Lawmakers didn't create HB 1284, with video monitoring and "seed to sale" tracking just to have the whole thing circumvented by an MMJ "farmer's market"...

And the law says you can smoke with, buy from, or sell to anyone who says they have their card and they never have to show it to you. I talked to someone there. He had a shirt on that said "Yes I Am _____" I forgot his name. He won a case that proved that the constitution says that the patient has the sole responsibility to decide how many plants he should have and how many ounces. And Dr's can recommend however many they see fit too.

The State has set up rules/regs for tracking and sales. never ever (especially in this industry) take someone else's word for something that will land your ass in jail. open sales outside the state system WILL get you in hot water. sharing meds, no biggie. but try the BS of buying/selling to someone without a VALID card TO SHOW YOU and you will eventually get caught and boned by bubba (and not bubba kush).

It's not a "framers market" as I said before, it's a "Meet and Greet". No one assosiated with the event, or who has a stand can sell THC stuff, only hand it out. Only bongs and pipes are sold. Cooking lessons and THC stuff is randomly for sale by people attending.

I wasn't selling anything. But if they asy they have one, it's not your fault. As long as you can some way prove you thought they had one. Recording of them saying it, a text, or they are handicapped. I'm sure he didn't lie to me about the law. I'm not trying to go around testing it though.

I am not spreadin misinformation. I even just backed up what I said. He wasn't just some dumb ass. He went all the way to the supreme court and beat this shit. It's not "I didn't know any better." It's "He said he had his card, and was complying with the amendment."

If you have Text message or some kind of evidence of the person saying they have their card, I bet you that's enough. Your not a government, or even licensed facility. What right do you have to go making people show you their card??

Doesn't matter if the cop buys it. Just has to hold up in court.

and like I said, good luck spending $30K+ to defend it. did the person you speak to happen to mention how much it cost him to defend his position? not trying to be a dick, just trying to point out that other people read these threads, and giving out info that doesn't hold up will cost people a lot of $$ and potential personal heartache. those without the funds will instead spend time locked up, not able to defend thier 'position'. unless of course the person has a VERY legit and obvious problem .... wanna bet 60%+ cardholders wouldn't hold up to in depth scrutiny?

No he didn't tell me court fee's. But with him sitting there I bet a cop would think twice before losing his job. Because he doesn't have to fight it twice, and could easily help someone he watched get arrested fight their case. Not that he would throw down money, but I bet that would intimidate a cop. I bet that's why they don't show up, at least in uniform. They don't want to get hassled by the known advocates that have already defended themselves and can't really be messed with. Because I bet if a cop started walking around asking for cards or something they'd find a way to get him out.

And I'm sure the people that are there could suggest some helpful people and lawyers to you before you got put in the car, if you got cuffed there.

I'd love to have people tossing out helpful suggestions and lawyers names as i'm getting hauled away .... this would make me feel so much better about the ass fucking I'd be subjected to in the CO Court system, while my family sits there and watches me rot away behind bars .... and then, after I've won and get released, I get to look forward to (somehow) paying back the thousands of dollars in legal fees.

Never believe anything you hear and only half of what you see. No one said that you were lied to, it is extremely common in this extremely regulated market to NOT understand all laws fully, therefore everyone interprets the laws in their own way, often incorrectly and then spread that info. That is why we call it spreading misinformation, not lying, its not that cut and dry.
The ones to listen to are lawyers and those who have already and continue to pay lawyers to keep them on the up and up.
He took it to the Colorado Supreme Court? You do understand that to get to the Supreme court you must LOSE trials and be found guilty several times and appeal every decision to the supreme court. So the $30k in legal expenses eyecandi was talking about may even be a little low.......

Dude, the CO court system wouldn't be shit in that situation. MANY witness's, MANY people that know what they are doing, in attendance. Co has legal buds, it's not that difficult. It's in the constitution.

And at the event your not going to get arrested for someone not having there card and you selling to them. If they are at the event, their card was checked at the door. So if someone sneaked in, it's not your fault. It's the event holders.

And I talked to that guy, he went to court for having like 40 plants. But he fought it and won. Because the constitution says that as a rd card holder, you decide what you need. As long as you can hold up that you need it in court.

People with a recommendation and a red card mean the same thing. And that's what the constitution says, if you have a recommendation.

You are allowed 6 plants (3 veg/3 flower) and no more than 2 oz of usable mj under the Colorado Constitution.
You can raise an affirmative defense for more plants or weight with a doctor qualifying you.
The option to raise an Affirmative Defense only happens after you are arrested, charged and arraigned.

Recommendations are not the same as a Red Card. A Red Card only comes after you sent the paperwork in.
You are allowed to procure/use mmj while you are waiting the 35 day period for the State to accept or deny your
application to be placed on the Medical Marijuana Registry via a copy of your doctor recommendation, copy of
notarized application and PROOF you sent it in; the Red Card is your certificate of your acceptance.

Having a recommendation and proof of mailing/Red Card only means you can raise a defense of possession/consumption of marijuana.
Distribution is regulated by SB's 1284/1043.


Red Card Only Events are not legally sanctioned or outlawed under this legislature. Please use your best judgment because if the cops wanted too they could.
