bob i was just looking through this forum which has exploded and would like to remind you that we are a seizure for profit state. let me explain how that works cause it seems like you dont understand. for example big daddys compassion center is raided a ton of meds are confiscated with 25,000 in the safe along with it. your local or state or federal agency walks out pressing no charges and keeping that money .........a few hours later they open back up ....... never ever ever to see anything seized aging.when they come to your house take all of your equipment destroy your plants and then take all your cash in the safe(sal agro) what do you call what they are doing with that money!
Doesn't happen that way. We care a seizure State, as are most, and the FEDS. That's about the only part you have right.
Seizures can not be kept without charges filed. Unless the stae deems those siezure forfiture as "penalty paid" by the offender, in exchange for no charges.
Without charges , any individual, or the compassion club you mention, shou;ld be able to get the confiscated goods, cash, or their cash value back.
The compassion club that re opened with no charges filed, probably took a deal from the State. They obviously have deep pockets, or they would't have been able to re open after a seizure of that Magnatude.
Example: State says..Well, you got $25k in cash, that's 15k over the cash transaction size set by the federal government, and you can't show us any deposit slips showing cash flow of this magnitude. And you've got 13 lbs of cannabis, over the highest card count you can come up with. We have a problem MR. Dispensary.
Dispensary owner says: But we didn't know! We thought that we could just put the cash directly in our pockets rather than go through that whole banking thing. We thought we could have that much cannabis on hand being a dispensary and all.
State says: Really, we find that hard to believe. I'm afraid we'll have to shut you down, sieze everything and file charges against the individuals responsible.
Dispensary says: Is there anything we can do? We were only trying to help.
State Says: well, I suppose we could keep the cannabis that was over the limit for your cards. And I suppose we could keep the cash that you can't show proper accounting for. Those would cover our expenses for this whole event. If you can agree to that. We'll take you at your word, and allow you to reopen.
Dispensary say: Oh! Thank You Mr State. We''l never do it again! thank's for Clarifying!
In the real world..it goes a lot more like that...
You may view that as State Extortion...I view that as State leniency.
I have 3 friends in Ionia county that have been raided. All are caregiver operations of 5 patients 60 plants.
All were caught with too many plants, and too much dry product. In all 3 cases, the cops killed enough of the smallest plants to get plant count right. Then took all the dry marijuana over the 12.5 he was allowed by card counts. Filed no charges.
Said to the grower: Okay, that gets you back to proper levels. Next time we will view it as intentional and press charger. Please comply in the future. Have a nice day.
That's leniency..not "profit by seizure"
