using an "old " form, or marking up one of your own is fraud. the agreement is only valid when it is agreed to. if he deliberately says he does not agree then you cant legally do shit except not hire him.
remember that this is an AGREEMENT to allow you to withhold THEIR pay for the GOVERNMENT'S convenience.
note the little "Exempt" checkbox at the bottom. this is not a declining of the agreement, it's agreeing to the government's withholding in principle, but setting the withholding at $0, you cant use that to avoid the problem either. they will simply withhold whatever they wish if they dont believe he falls into the category of "Persons who agree in prinicple, but dont believe they will owe any taxes" once he signs the agreement he is legally bound to it, and if he does not qualify as exempt, he will be longdonged.

An unsigned W4 is an invalid W4 any way you look at it and the IRS makes it clear to the employer that we must take default deductions.
Think about it, let's say for arguments sake your contention has merit. With all the readily information on the internet, don't you think thousands if not millions of employees would already be taking advantage it?
BTW, I just pulled a blank W4 out and it clearly states below "Employee's Signature" (This form is not valid until you sign it)
you are both very wrong. the w-4 is not a tax. it is an agreement to allow the employer to garnish your wages on behalf of the IRS . the IRS says it is "Mandatory or many bad scary things will happen to the employer", so the employer says the employee must sign it or not get hired.the point you are trying to make is that if someone else doesn't sign a W4, you still have to pay the taxes involved for that other person.
but no one is ever forced to sign a W4. the point remains.
and to address your retarded point, no one is ever forced to start a business and offer other people W4s to sign. that is your voluntary choice.
